EU Directive 2023/970 to eliminate the gender pay gap using mandatory transparency measures will be enforced in Romania soon

To apply the Directive (EU) 2023/970, Romania will transpose its provisions into national law by 07.06.2026.

The main actions that the Romanian State will undertake include:

– Romania will adopt laws prohibiting employers from restricting employees from communicating their salary or requesting information about remuneration levels,

– it will be introduced the obligation for employers to provide candidates with information about the starting salary or salary range, either in the job advertisement or before the interview,

– the employees will have the right to request data from their employer on the average salary level, broken down by gender, for categories of workers performing the same work.

Also, the relevant legislation:

– will define “effective, proportionate and dissuasive” sanction for companies that do not comply with transparency rules,

– legislation will allow the employees who have suffered salary discrimination to obtain full compensation (retroactive payment of the differences and related bonuses),

– in the event of a dispute, the employer will be the one who must prove that there was no discrimination, if it has not fulfilled its transparency obligations.

New tax deduction for employees for investments made on the capital market

Starting with 01.03.2026, the employees from Romania can benefit from a tax deduction of up to 400 EUR per year for investments made on the capital market. This measure was introduced by GEO no. 8/2026 as part of an economic recovery package.

The employees do not receive money directly, but they have the right to deduct the invested amount (up to EUR 400/year) from their gross income before the 10% income tax is applied. Thus, the real savings to his/her personal budget are approximately 40 EUR per year (10% of EUR 400).

The eligible financial instruments are investments in shares, bonds and ETF (Exchange-Traded Funds) units. Government securities from the Fidelis program are also included.

The investments must be made through authorized intermediaries (brokers) in recognized stock exchanges, such as the Bucharest Stock Exchange (BVB). The Fiscal Code stipulates that these may be investment management companies, self-managed investment companies or alternative investment fund managers.

The employees must present to the employer the supporting documents from the broker to benefit from the monthly or annual tax deduction.
